Abstract

Development and annexation agreements offer assurance to both developers and governmental entities involved in land development projects. The developer is offered assurances that the project will be completed and the government gains control over construction and is able to secure public facility dedications and authorize impact fees sometimes beyond that which can legally be required under case and statutory law. This paper discusses at length California’s experiences relating to vested rights and the use of development agreements, annexation agreements and vesting tentative map statutory procedures set forth in the State Subdivision Map Act.
